FMLA Leave of Absence

California Family Rights Act (CFRA) / Family Medical Leave Act (FMLA)

If you are in need of a medical leave to care for yourself, a spouse, a child, or a parent, then you may be eligible for a CFRA / FMLA leave of absence. To be eligible, you must be a permanent employee, have worked for Tuolumne County for at least one year, and have worked 1,250 hours in the past 12 months.


Leave of Absence

Tuolumne County provides up to 12 weeks of CFRA / FMLA leave in a 12 month period, depending on the provisions of your MOU. The 12 week period is a "rolling forward" period beginning on the date you are injured or become ill. All accrued time (sick, vacation, floating holiday) and workers' compensation will run concurrently with FMLA leave. You will continue to receive a cafeteria allowance while using your accrued time. Once you have used all accrued time, the county will pay your health insurance premiums for the remainder of your leave period. Should your leave be extended by approval beyond 12 weeks, you will be notified of your right to purchase health insurance at your own cost. If your insurance has been waived, insurance premium payment will not be available to you.


Disability Benefits

If you are enrolled in voluntary short term disability insurance and will be out of work due to a non-work-related medical issue, you may be eligible to receive disability benefits. Short term disability insurance has a 14 day waiting period and benefits may be paid up to a maximum of 11 weeks. Short term disability insurance pays 55% of your weekly income beginning on your 15th day of absence.
